If he has no grounds for appeal, such as misdirection by the judge or some other valid point of law, he will not be allowed to appeal. In any case, an appeal is not a retrial and the defendant is often not required to attend.

An appeal is not a retrial, but this is not an appeal against sentencing, which has yet to take place.

The appeal is against the validity of the conviction. Not a retrial, but an attempt to quash the verdict altogether.

As is his right under law. I have no problem with that. If he felt that the guilty verdict came about as a result of misdirection, he would either get a retrial or, less likely, an acquittal.

It's clear that Mujahid Abu Hamza killed Lee Rigby. The only reason Mujahid Abu Hamza can have for appealing the verdict of murder is to promote his political views. The court system should not be used for that.
